Do I need to lodge an SGC statement if I paid late?

Short answer

Yes, for any quarter ending on or before 30 June 2026 you must lodge an SGC statement even though you have now paid the super. Paying the fund late does not cancel the super guarantee charge or the duty to report it. For pay days from 1 July 2026 there is no statement to lodge; the ATO assesses the charge itself, and a voluntary disclosure takes its place.

Why paying late does not replace the statement

Under the quarterly rules, the moment a contribution is received after the 28th, the law replaces your ordinary super obligation with the super guarantee charge. The late payment to the fund is welcome for your employee, but it does not satisfy the charge. The charge is owed to the ATO, and the SGC statement is how it gets reported.

The statement is due one month after the missed contribution deadline:

QuarterSuper dueSGC statement due
1 July to 30 September28 October28 November
1 October to 31 December28 January28 February
1 January to 31 March28 April28 May
1 April to 30 June28 July28 August

For the final quarterly period (April to June 2026), the ATO's transition guidance is explicit: if the payment was late, lodge the SGC statement by 28 August 2026 and pay the charge.

What happens if you skip it

Not lodging is where the real damage happens, and it is worse than the charge itself:

Lodging on time even when you cannot pay keeps the director penalty in the non lockdown category and keeps penalty remission on the table.

Can the late payment reduce what you owe?

Under the old rules, the SGC statement is also where you elect the late payment offset. That election lets a late contribution reduce the shortfall and nominal interest components, though never the $20 administration fee, and the offset amount is not tax deductible. The offset only works where the fund received the contribution on or before 30 June 2026 and the quarter ended no later than 31 March 2026. It is not available for the June 2026 quarter, and the election is binding once made, so check the numbers before you lodge.

For pay days from 1 July 2026, payday super removes the statement altogether. Instead, you can lodge a voluntary disclosure statement at any time before the ATO issues an assessment. A late contribution automatically reduces the shortfall, and a disclosure lodged within 30 days can reduce the administrative uplift by up to 40 percentage points.

If lodging the statement will create a charge you cannot pay, that is not a reason to hold off. Lodge first, then ask the ATO for an ATO payment plan for the balance.

What to do next

  1. Work out which quarters were paid late and whether each one ended before or after 30 June 2026.
  2. Lodge the SGC statement for every late quarter up to June 2026, using Online services for business or through your tax agent, even if the super has since been paid.
  3. If a quarter ended on or before 31 March 2026 and the fund received the payment by 30 June 2026, consider electing the late payment offset in the statement.
  4. Set up a payment plan for any SGC you cannot pay on lodgement, and ask about Part 7 penalty remission at the same time.

What if I lodged the SGC statement late but before the ATO contacted me?

You still have to pay the charge, and the director penalty for that quarter is a lockdown penalty because the statement was after its due date. However, coming forward before any ATO contact is the single biggest factor in Part 7 penalty remission, and it usually leads to most or all of that penalty being removed. It is always better than waiting for a default assessment.

Do I lodge an SGC statement for a late payment made after 1 July 2026?

It depends on the period the payment relates to. For any quarter ending on or before 30 June 2026, yes, a statement is still required. For pay days from 1 July 2026 there is no SGC statement; the ATO assesses the charge from payroll and fund data, and you can lodge a voluntary disclosure statement instead to reduce the uplift.
